In accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the “Law”), and for the purpose of protecting the personal data of third parties held by the company “Procesos Industrializables Creativos, S. de R.L. de C.V.” (the “Company”), with address at Pablo Neruda 2556, 3rd and 4th Floor, Providencia 3rd Section, C.P. 45100, Zapopan, Jalisco, this Privacy Notice (the “Privacy Notice”) is established under the following terms:
This Privacy Notice aims to protect any information related to identified or identifiable individuals (“Personal Data”), such as employees or job applicants related to the Company (the “Data Subjects”), regulating the use and protection of the Data Subjects’ Personal Data through legitimate, controlled, and informed processing in order to ensure their privacy, as well as their right to informational self-determination.
The Data Subjects accept and authorize the Company to use and process their Personal Data and any information provided, through automated means, which will become part of the Company’s database, for the purpose of using such information, including but not limited to: (i) identifying, locating, contacting, and sending information to the Data Subject; (ii) evaluating their capabilities and aptitudes to offer employment or promote them within our organization; (iii) contacting their personal references to evaluate their moral and social suitability to perform a job position; (iv) creating and keeping updated their human resources file in the event they are hired; (v) granting the employment benefits corresponding to them in accordance with the applicable law and their employment contract in the event they are hired; (vi) providing information to labor, tax, or other authorities who request it or to whom the Company is legally obligated to deliver information; (vii) sending job offers or information regarding their employment relationship, including applicable policies, regulations, and related matters. The use of Personal Data will relate to the type of interaction the Data Subject has with the Company, which is of an employment-related nature.
The Company, as the party responsible for the processing of the Data Subjects’ Personal Data, is obligated to comply with the principles of legality, consent, information, quality, purpose, loyalty, proportionality, and accountability established by the Law. Therefore, pursuant to Articles 13 and 14 of the Law, the Company commits to maintaining strict confidentiality of the Data Subjects’ Personal Data, as well as to implementing administrative, technical, and physical security measures to protect such data against any damage, loss, alteration, access, use, disclosure, or unauthorized processing.
The duration of the processing of the Data Subjects’ Personal Data will be indefinite starting from the date on which the Data Subjects provide such data to the Company, and they may object to such processing at any time they deem appropriate, in accordance with the Law.
Furthermore, under Article 22 of the Law, Data Subjects have the right at any time to exercise their rights of access, rectification, cancellation, and objection regarding the processing of their Personal Data, via an email request addressed to contacto@huber.design, attention to Bibiana Huber or Human Resources, or through a written notification delivered to the Company’s address.
